Another Pervert At Walmart

John L. Pena is charged with misdemeanor voyeurism after Boise police say he was caught trying to watch a 12-year-old girl in a changing room in the Wal Mart at 8300 W. Overland Road Sunday afternoon.

Police began their investigation after an employee at the store called around 5 p.m. Sunday to report that he had noticed a man, later identified as Pena, was hanging around the clothing section at the store and then going into changing rooms a short time after women would go in.

It was when the employee saw Pena walk into the dressing room shortly after a young girl walked in that he got the girl’s mother to go into the room and get her out right away. The employee then went into the dressing room and saw Pena get on his hands and knees and look under the divider into that dressing room, according to reports. The employee told police when Pena figured out it was an employee in the changing room instead of the girl he got up and quickly left. Police caught Pena as he was walking out of the store, according to reports.

Police arrested Pena on the misdemeanor voyeurism charge and booked him into the jail, where he bonded out, only to be arrested and put back into jail about five hours later on an unrelated felony probation violation charge, according to jail records.

It is unclear what agency arrested Pena the second time but Idaho court records show Pena has a felony burglary arrest from 2007 that appears to be why he is charged with a probation violation.

The misdemeanor charge of voyeurism is punishable by up to six months in prison and up to a $1,000 fine, according to Boise City code.
